++The Department does not sponsor non-immigrant work visas for this position.++ As an attorney at the Nebraska Department of Revenue (Department), you will work with a group of attorneys who are dedicated and focused on the Department's mission to serve the public by administering the state revenue laws with integrity, efficiency, and consistency; gain in-depth knowledge of Nebraska tax laws and the inner-workings of tax administration from a perspective few citizens see; gain valuable experience with complex business transactions, while increasing your professional standing and reputation in the legal profession; receive paid Nebraska State Bar Association mandatory membership and approved continuing legal education credit hours; and benefit from a flexible work schedule that allows for a great work/life balance.

The Attorney III starting rate is $67,003 annually with a 5% increase after successful completion of the six month probationary period. This position may be understaffed at the lower Attorney levels (II or I) in the event the candidate does not fully meet the Attorney III qualifications.

The Attorney II starting salary is $53,928.

The Attorney I starting salary is $46,661.

A candidate hired as an Attorney must demonstrate the ability to advance to the Attorney III level. Under administrative direction, provides professional legal services for an agency involving a complex body of law in the research, administration, and enforcement of the agency's statutory authority and obligations; performs related work as assigned.

Examples of Work

1. Review, evaluate, negotiate, and litigate protested tax assessments through the Department's formal hearing process. 2. Assist the Attorney General's office in certain matters involving the Nebraska Department of Revenue . 3. Conduct complex and varied research in all areas of taxation and related subject matters. 4. Research and draft legal documents. 5. Provide legal opinions, advice, and recommendations to Department staff. 

Qualifications / Requirements

REQUIREMENTS: Attorney III: Three years of experience as an attorney practicing law and providing legal services such as preparing and trying cases, advising clients, and/or interpreting laws or administrative policies. Attorney II: One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies. Attorney I: Graduation from an accredited school of law and admission to the Nebraska Bar.

PREFERRED: Recent experience in litigation and knowledge of the discovery rules; corporate and individual income tax; state and local tax; bankruptcy litigation; criminal litigation; audit and financial record review and/or experience in Federal and/or State tax research; probate and collection law; administrative law practices; high academic performance; course work with an emphasis in taxation, accounting or auditing.

OTHER: In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l943, incumbents in this class must be admitted to the Nebraska Bar. Applicants who are eligible to be admitted to the Nebraska Bar will be considered, however, you must be a member of the Nebraska Bar prior to employment.

Knowledge, Skills and Abilities

Knowledge of: The techniques of preparing and drafting of legal documents and forms; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings; state and/or federal statutory and case law and constitutional provisions pertinent to agency programs; the principles and practices of criminal and civil law administration. Skills in: Preparing summaries, legal analysis, findings and conclusions, briefs and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of contentious goals or viewpoints; analyzing and interpreting various factors, perspectives, and options and applying critical thinking to resolve issues. Ability to: Prepare & communicate in person & by phone, emails, summaries, & correspondence, the facts and arguments of a case to persuade others to accept the viewpoint presented; work collaboratively as part of a team; interact collaboratively and respectfully with other attorneys within the Department, other governmental employees, the public, and representatives of parties involved in a case; formulate legal opinions and recommendations based on legal research and investigations; conduct legal research and investigations; identify critical elements of legal questions or issues; prepare/draft legal documents and forms; interpret and apply statutes, case law, decisions of courts and administrative tribunals, and administrative rules and policies.
