Position Purpose

ADA Manager II
(Non Civil Service Position)

The ADA Manager will perform moderately complex management or oversight activities for the daily operations of the City's ADA program. The ADA manager will develop guidelines to ensure the organization is in compliance with federally required ADA mandates.  The manager is responsible for establishing short, mid and long-term goals and objectives for this program based on ADA best practices, requirements, procedures, rules and regulations; developing schedules, priorities, and standards for achieving established goals.

The manager will coordinate and evaluate program activities; develop and evaluate budget requests; plan, assigns, and/or supervises the work of others. This person will work under limited direction with latitude for the use of initiative and independent judgment.

Specifically, their ADA related responsibilities include assuring compliance with the Americans with Disabilities (ADA) Act, Sections 503 and 504 of the Rehabilitation Act of 1973, and other federal and state laws and regulations pertaining to persons with disabilities. The ADA manager is responsible for developing City of Dallas' policies and procedures relating to persons with disabilities, monitoring their implementation, as well as state and federal laws relating to persons with disabilities, filing all necessary reports, and providing consultative services to city departments and interacting with interested external parties.

Reports to the Chief Ethics and Compliance Officer for the City of Dallas; Serves as the planning coordinator for City of Dallas programs, policies, and procedures relating to compliance and the promotion of opportunities for persons with disabilities.

Compliance Process Responsibilities:
Ensures that appropriate processes are in place to provide for the prompt and equitable resolution of complaints and inquiries from employees, the public and Federal /State regulators regarding compliance with the ADA and other applicable federal and state laws regarding discrimination on the basis of disability.
 
Investigates allegations of discrimination and non-compliance under the ADA and other applicable federal and state laws regarding discrimination on the basis of disability.
 
Maintains a record of all disability, reasonable accommodation, and effective communication requests/complaints or issues and the resolution of each request/complaint/issue for persons with disabilities.
 
Manages the implementation and facilitation of the Reasonable Accommodation (RA) and Effective Communication (EC) process: develops and implements procedures by which employees' and applicants' requests are addressed; provides technical assistance, advice and  facilitation to City departments regarding RA and EC requirements; provides alternate formats of communication where necessary; provides information and referrals; maintains confidentiality of all applicable personal, disability, medical or clinician provided information; works in conjunction with Human Resources to make recommendations for reassignment opportunities for employees seeking RA; advises county program/service providers on their responsibilities under the ADA, including the provision of Reasonable Modifications to policies and practices for the general public they serve. 
 
Maintains current information regarding state and federal laws and regulations as well as the best practices of ADA Compliance concerning the rights of persons with disabilities and ways of providing RA to persons with disabilities while maintaining program performance standards.
 
Outreach Responsibilities:
Develops and maintains written materials and other informational pieces to broadly disseminate information regarding the ADA relating to persons with disabilities.
 
Designs and presents staff training materials on the provision of equal opportunity for persons with disabilities.
 
Serves as the City of Dallas liaison with relevant state and federal agencies, other ADA coordinators and associations, disabled persons and employees.
 
Technical Assistance and Barrier Removal Responsibilities:
Provides technical assistance and expertise regarding barrier removal and the physical accessibility of City of Dallas owned or leased facilities: addresses inquiries, requests and complaints of accessibility for the physical facility; conducts site reviews of facilities; drafts site review documents and findings, including technical reference drawings for remediation of access and/or compliance concerns of identified barriers; provides input and direction to design teams and architects for new and renovation construction projects, including design review, site visits during and after construction, and compliance review.
 
Provides technical assistance and expertise regarding accessibility of programs, services and activities: receives and reviews ADA related inquiries and grievances; provides response or makes recommendations for response as appropriate; develops and implements departmental procedures; ensures service delivery in a non-discriminatory manner; provides guidance to City administration and department staff and external organizations specific to the ADA; makes recommendations for 'best practices' for disability related inquiries.

Essential Functions

  1. Assists in the development and implementation of a citywide Self Evaluation Plan for ADA compliance: provides guidance and expertise in the planning stages; creates project schedule; drafts Request for Proposal and participates in contract negotiations; coordinates with and oversees contractors; conducts training, including regulations, access to services, program accessibility for service delivery and sensitivity to persons with disabilities; creates database for capture of access elements; develops corrective action plan and Transition Plan for remediation against related deficiencies.
  2. Develops guidelines, procedures, policies, rules and regulations and monitors compliance with policies; and procedures as it relates to ADA and related subjects;
  3. Identifies needed areas of change and makes recommendations to improve operations. Directing others to implement corrective action, responsibility;
  4. Plans, assigns, and/or supervises work of others, including lower supervision levels;
  5. Establishes short, mid and long-term goals and objectives; develops and/or approves schedules, priorities and standards for achieving goals; and directs evaluation activities;
  6. Oversees the preparation of management and productivity reports, analysis and/or studies;
  7. Oversees special investigations, internal audits, and research studies;
  8. Oversee the preparation of and evaluates budget request;
  9. Oversees the planning, development and operation of special projects;
  10. Provides technical guidance in the unit or functional program area;
  11. May contribute to the preparation, development, review and/or revision of ordinances.
  12. Regular, reliable and punctual attendance is an essential function of the job.

Minimum Qualifications

Bachelor's Degree in Public Administration, Business Administration, Construction Management, Human Resources, or closely related field; supplemented by five years of experience in ADA/Section 504 compliance, accessibility of programs, services and activities, and physical accessibility for design and construction/barrier removal to include lead or supervisory experience; or any equivalent combination of education, training, and experience which provides the requisite knowledge, skills, and abilities for this job.
 
Specific License or Certification Required: 
Must possess and maintain a valid Texas driver's license or have the ability to acquire a Texas Driver's license within 30 days of hire.
 
Having a certification or license in a specialty area, such as ADA Coordinator Training Certificate Program (ACTCP), Society for Human Resource Management (SHRM), Human Resources Certification Institute (HRCI), International Public Management Association for Human Resources (IPMA-HR) or certified mediator preferred. Having and maintaining certification as Accessibility Plans Examiner from the International Code Council/International Building Council or other accredited school or agency within Texas is also a plus, but not a requirement for the position.

  9. Ability to develop/plan administer budget;
  10. Ability to communicate effectively, at all levels, both orally and in writing; and
  11. Ability to establish and maintain an effective working relationship with all levels of management city officials, vendors, other government agencies, other employees and the general public.
  12. Ability to coordinate, manage, and/or correlate data, and to exercise independent judgment to apply facts and principles for developing approaches and techniques to resolve problems. And
  13. Performs other related duties as required.
 
Must be able to demonstrate proficiency in performance of the essential functions and learn, comprehend, and apply all county or departmental policies, practices, and procedures necessary to function effectively in the position.
 
Working Conditions and Hazards
Dependent upon unit or program assignment, usually normal office conditions.  Subject to normal traffic hazards, considerable walking, standing, climbing and stooping when working in the field.
